San Clemente Aims to Fight Sadeghis' Demand for Millions
In closed session Tuesday, council voted to fight the erstwhile Playa Del Norte developers who sued for damages in November in a second legal action against the city related to the failed North Beach development.
The city of San Clemente means to fight a suit by the erstwhile developer of the Playa Del Norte commercial project that was shot down by voters in March.
The suit demanding millions in damages is the second legal action by developers Linda and Shaheen Sadeghi related to the project; the first legal action was a petition asking a judge to throw out the results of Measure A, which is still in the courts.
The November suit argues that the city was disingenuous and claims elements of racism in the campaign against the ill-fated retail and restaurant project at North Beach.

City Attorney Jeff Oderman said the council voted to assert that the Sadeghis' claims were baseless because the exclusive negotiating agreement between the city and the Sadeghis' LAB development company was null and void because of the results of Measure A.
Furthermore, Oderman said, provisions of the contract said either party could pull out at any time.
The city will send the LAB a letter asserting that the exclusive negotiating agreement is no longer in effect.

We as the voting community need to make our voices heard. This vote was legitimate and finale. This had nothing to do with the city. If anything the city did EVERYTHING to give these kooks our land. Much to their surprise we spoke up and used our rights as tax paying citizens to stop the land grab and claim what is rightfully ours. Who has see Linda or Shaheen in town parading around like loving "locals" (from Laguna Nigel) since the vote? You haven;t because it was all a lie, a huge marketing scam!

I am concerned that Oderman, Dahl, Donchak and Evert are still in bed with them. This could be big play on us all. Lets not forget that Oderman and D,D,E were the ones negotiating with them behind closed doors and authorized the cities website to become their own marketing website. something smells here.

I understand that the General Plan Advisory Committee (GPAC) is advising that the city-owned property at North Beach south of El Camino Real - the public parking area and the lots along ECR - could be used for commercial development. I find that hard to believe !
By soundly defeating proposition A last March, the voters of San Clemente made it abundantly clear that they do not want a commercial development there. They also made it clear in the debate leading to the election, that the use of the properties - public use, public improvements, public parking or a park - as declared in the city's resolutions (69-70 and 94-55) for the acquisition of the properties by eminent domain, and which do not allow commercial developmten, was not to be changed.
The current zoning of the parking area (P- Public) conforms with the intent of its acquisition resolution (Resolution NO. 69-70), but the current zoning of the ECR property (MU- Mixed Use) is not consistent with the intent of its acquisition resolution (Resolution NO. 94-55) and therefore must be changed to conform with the resolution, like the parking area does.

I vehemently urge the city council to listen to the electorate, and to its own good sense, and make it explicitly clear in the updated City of San Clemente General Plan that those properties are to be used as originally intended, and as desired by the voters. Not for commercial development. We do not want to go through the LAB/Playa del Norte fiasco all over again.

@ Steve they are business owners and I'm with you in that I appreciate what they have done with the Casino and I thank them truly. On the topic of frivolous lawsuits against our city all because their inability to live in reality I say they sure act like monsters. Those kooks lied and cheated the residents of SC all in the hopes of a multi million dollar land grab. They paraded around town lying through their teeth. They pushed a project on this town we did not want and divided neighbor against neighbor all for their own benefit. Sore losers now they want to sue. Their smiles are as crooked as their business ventures.

Sadeghi's company sued 195 Downtown Grill for not paying the new rent, and on Monday, Dorsey lost the case. Dorsey said it was due to loopholes. Anaheim's redevelopment agency, which previously managed Center Street, found the bar was late on rent once in 2009, and therefore, the 15-year lease was nullified. Also, the lease required that the bar serve lunch, and Dorsey stopped doing so because it wasn't profitable.
Dorsey, who is known in the community for hosting charitable events, says that for the past six months, he has "watched lives get turned upside-down" because they didn't fit into the city's vision, and blames Sadeghi for "swallowing the little guy."
"Our goal now is to just let everyone know what this guy is doing and all the people he's hurting," Dorsey says. "These little guys don't have the money or power or network to have a fair fight. I've got 30 employees who are going to be without Christmas gifts this year. I'm more worried about them than myself."
Yet again, the good guys finish last...
