Domestic Violence Case against Cop from SC Dismissed

A judge threw out the case last week after the officer's wife refused to testify.

A domestic violence case against a Los Angeles police officer accused of threatening his wife was dismissed last week when she refused to testify against her husband, the officer's attorney said.

Dale Wayne Ziesmer, 48, of San Clemente, faced trial on a felony count of criminal threats and could have been sentenced up to three years in prison if convicted.

Orange County Superior Court Judge Steven Bromberg March 25 granted the defense a motion to dismiss the charge when Ziesmer's wife testified she did not wish for the case against her husband to continue, Ziesmer's defense attorney Jacqueline Goodman said.

"His wife never supported the prosecution," Goodman said.

Ziesmer's wife also refused to testify at the preliminary hearing, Goodman said.

Goodman also presented statements from the wife and other witnesses the attorney called favorable to the defense.

Ziesmer was accused of threatening the woman Sept. 25. She told a friend, who is also a Los Angeles police officer, who reported the alleged threat to Los Angeles investigators, according to the Orange County District Attorney's Office. Ziesmer and his wife are in counseling, Goodman said.
