Hearing Is Near on Sadeghis' Petition to Scrap Measure A Results

A hearing on the merits of the court petition is scheduled for July 28, city officials say.

Action on a  election is being taken this month.

Though City Attorney Jeff Oderman asserts the developer doesn’t have a valid case, he said a hearing on the merits of the petition is slated for July 28.

Shaheen Sadeghi is head of the LAB development company, which planned to build a 50,000-square-foot retail center at North Beach. in a March 8 special election .

After Sadeghi, his wife, Linda, and project supporter Jeanne O’Grady filed in April for a writ of mandate that would scrap the vote results, the city of San Clemente filed a motion asking the judge to throw out the petition, said Oderman.

Oderman said that because of procedural protocol connected to subsequent court filings by the Sadeghis, the judge couldn’t summarily toss out the case. As a result, the hearing was scheduled.

The Sadeghis are alleging that the ballot title was misleading. It also questions the city attorney's impartial analysis. The suit also names the  Orange County registrar of voters, Neal Kelley, saying he did not include the full text of the Measure A ordinance or a message telling voters where to find the full text, among other procedural legal concerns.
