San Clemente Aims to Fight Sadeghis' Demand for Millions

In closed session Tuesday, council voted to fight the erstwhile Playa Del Norte developers who sued for damages in November in a second legal action against the city related to the failed North Beach development.

The city of San Clemente means to fight a suit by the erstwhile developer of the Playa Del Norte commercial project that was shot down by voters in March.

The suit demanding millions in damages is the second legal action by developers Linda and Shaheen Sadeghi related to the project; , which is still in the courts.

The November suit argues that the city was disingenuous and claims elements of racism in the campaign against the ill-fated retail and restaurant project at North Beach.

City Attorney Jeff Oderman said the council voted to assert that the Sadeghis' claims were baseless because the exclusive negotiating agreement between the city and the Sadeghis' LAB development company was null and void because of the results of Measure A.

Furthermore, Oderman said, provisions of the contract said either party could pull out at any time.

The city will send the LAB a letter asserting that the exclusive negotiating agreement is no longer in effect.
